Terms of Service – NKN Web Design LLC

These Terms of Service (“Terms”) govern the relationship between NKN Web Design LLC (“Company,” “we,” “our,” or “us”) and the client (“Client,” “you,” or “your”) for web design and related services. By engaging NKN Web Design LLC, you agree to these Terms in full.

1. Services Provided

  • NKN Web Design LLC offers website design, development, and related digital services as outlined in the project proposal or contract.

  • All services are tailored to the Client’s specifications and delivered according to the agreed project scope.

2. Payments & Fees

  • A non-refundable down payment is required before any project work begins.

  • Remaining balances are due according to the payment schedule in the proposal or contract.

  • Work will not continue, and completed deliverables will not be transferred to the Client until all outstanding balances are paid in full.

3. Refund Policy

  • All payments made are non-refundable, except as outlined in the Refund Policy provided separately.

  • Dissatisfaction with creative direction, personal preference, or changes of mind do not constitute grounds for a refund.

4. Client Responsibilities

  • The Client agrees to provide all necessary content, images, branding materials, and feedback in a timely manner.

  • Delays caused by the Client (e.g., late feedback, missing materials) may extend project deadlines and do not relieve the Client of payment obligations.

  • The Client is responsible for ensuring that all materials provided (such as logos, images, and text) are free of copyright infringement and lawful to use.

5. Revisions & Scope of Work

  • The project includes revisions as outlined in the proposal/contract.

  • Requests outside of the agreed scope of work will be considered additional services and billed separately at the Company’s standard rate.

  • Excessive revisions beyond what is outlined may result in additional charges.

6. Intellectual Property

  • Upon full payment, the Client will receive ownership of the completed website files and content created specifically for the project.

  • NKN Web Design LLC retains the right to display completed work in portfolios, case studies, and marketing materials.

  • Any third-party software, plugins, or stock materials remain the property of their respective owners and are licensed, not sold.

7. Hosting & Third-Party Services

  • Unless otherwise agreed, the Client is responsible for securing web hosting, domains, and third-party tools or services.

  • NKN Web Design LLC is not responsible for downtime, errors, or failures caused by third-party providers.

8. Termination

  • Either party may terminate the project with written notice.

  • If the Client terminates, the Client remains responsible for payment of all completed work, including the non-refundable down payment.

  • NKN Web Design LLC may terminate a project for non-payment, breach of these Terms, or unprofessional behavior by the Client.

9. Limitation of Liability

  • NKN Web Design LLC is not liable for:

    • Loss of revenue, business opportunities, or data.

    • Security breaches, hacking, or malware affecting the Client’s site after delivery.

    • Issues caused by Client misuse, modifications, or third-party interference.

  • Our liability will never exceed the total fees paid by the Client.

10. Confidentiality

  • Both parties agree to keep sensitive project information and communication confidential unless otherwise permitted in writing.

11. Disputes & Governing Law

  • The Client agrees to resolve disputes directly with NKN Web Design LLC before pursuing external remedies.

  • These Terms are governed by the laws of the State of New Jersey, and any disputes will be handled in the jurisdiction of New Jersey courts.

12. Acceptance of Terms

By engaging NKN Web Design LLC and/or making a payment, the Client acknowledges they have read, understood, and agreed to these Terms of Service.
